Terms and conditions of the EthnoField online store

§ 1 Preliminary provisions

  1. The EthnoField online store available at  www.ethnofield.com is run by Szymon Bobrowski who conducts business under the registered name EthnoField Szymon Bobrowski entered into the Central Register and Information on Business Activity (CEIDG) conducted by the Minister competent for economy, NIP (Tax Identification Number) 7352510123, REGON (Statistical Identification Number) 123069918.
  2. This terms and conditions are addressed to Consumers and define the rules and procedur es for concluding a Sales Agreement with the Consumer at the distance through the Store.  

§ 2 Definition of concepts

  1. Consumer – individual concluding an agreement with a Seller within the online store, the subject of chich is not directly related to its business or professional activity.
  2. Seller – natural person running business under the register name EthnoField Szymon Bobrowski entered into the Central Register and Information on Business Activity (CEIDG) conducted by the Minister competent for economy, NIP 7352510123, REGON 123069918.
  3. Customer – any entity making purchase through the online store.
  4. Entrepreneur – any natural or legal person or organisational unit with no  legal personality whose legal personality is granted by the separate law and who is performing business activity on his/her own behalf and who is the online store user.
  5. Store – online store is run by the Seller under the following Internet address www.ethnofield.com
  6. Agreement concluded at a distance  - an agrement concluded at a distance  between the Seller and the Consumer as a part of the organised system of concluding distance agreements (within the store activity) without simultsneous physical presence of parties, with the exclusive use of one or more means  of distance communication until the conclusion of the contract, inclusive.
  7. Terms and conditions  - the following Terms and Conditions of the Store.
  8. Order – the Customer's declaration of intent submitted by means of the Order Form and aiming directly at the conclusion of the Product Or Products Sales Agreement.
  9. Account – the Customer’s account in the online store where the data introduced by the customer are stored and all the information concerning his/her purchase history.
  10. Registration form – a form available in the online store enabling creating the customer’s account.
  11. Order Form – interactive form available online enabling placing an order especially by adding products to the shopping cart and specifying terms and conditions of the Sales Agreement, including the method of delivery and payment. 
  12. Shopping cart – part of the software of the online store where the Products selected for purchase are shown by the Customer and where the Niven order May be determined and modified, in particular the quantity of the products orderd.
  13. Product – a movable item available in the Store or a service being the subject of the Sales Agreement between the Customer and the Seller.
  14. Sales agreement  - a product sales agrement concluded between the Customer and a Seller via the online store. The Sales Agreement also means, relatively to the product features, a contract for the provision of services and a contract for specific task.

  5. The customer shall communicate with the Seller by means of the addressess and telephone numbers listed above.
  6. The customer shall communicate by phone within the working hours i.e. 8:00 – 16:00

§ 4

Technical requirements

In order to make any operations in the online store, such as browsing the offer and placing orders, the following is needed:

a.    any device with the access to the Internet and a browser and an active e-mail account (e-mail);

b.   enabled Cookies,

§ 5

General terms

  1. The Seller etailer in the widest extent permitted by law shall not be liable for any disruptions such as interruptions in the functioning of the Online store caused by force mejeure, unauthorized activities of third parties or incompatibility of the online store with the customer’s technical infrastructure.
  2. Browsing the Store’s assortment doesn’t require creating an Account. Placing orders for products by the Customers shall be possibile either upon creating an account in accordance with the provisions of § 6 of the Terms and conditions or by providing the necessary personal data and addresses  enabling the order to be completed without creating an account. 
  3. The prices listed in the online store are given in Polish Zlotych PLN, EURO or USD and are gross prices (including VAT). 
  4.  The final amount to be paid by the Customer consists of the price for the product and the cost of delivery (charges for transport, delivery and postal services) about which the customer is informed while placing orders, including the moment of expressing a will to be bound by the Sales Agreement.
  5. When the nature of the subject of the Contract doesn’t allow, reasonably judging, for an advance calculation of the final price, the information on the method of calculation as well as charges for transport, delivery, postal services and any other costs that may occur, will be given in the Online Store in the description of the Product.

§ 6

Creating an Account in the Store

  1. In order to create an Account in the Online Store, the registration form should be filled. It is necessary to provide the following data: name and surname, gender, date of birth, address.
  2. Creating an Account in the Store is free of charge.
  3. Logging in to the Account is possibile upon entering the login and password set in the Registration form.
  4. The Customer has a right, at any time, without giving any reason and without incurring any fees, delete the Account by sending a relevant request to the Seller, in particular via e-mail or in writing to the address provided in § 3.

§ 7

Methods of placing orders

To place an Order the following course of action should be performed:

1.    log in to the On Line Store (optional);

2.    select the Product being the subject of the order, and then click the button (shopping cart) or equivalent;

3.    log in or use the option of placing an order without registration;

4.    if the option to place an Order without registration has been selected – fill in the Order form by entering the details required and the address to which the product delivery should be made, select the method of shippment (method of delivery of the product), write the data necessary for issuing the invoice if different from the recepient’s details;  

5.    Click the „Order and pay” button and confirm the order by clicking the link sent in the e-mail;

6.    select one of the available methods of payment and depending on the method selected, pay for the order within the specified period, subject to § 8 (3).

§ 8

Methods of delivery and payments

1.    The Customer can use the following methods of payment:

a.    Electronic payments

b.    Payments by credit cards

c.    Payments by PayPal

2.  Settlements of transactions by credit card and eprzelew are carried out via Dotpay.pl

§ 9

Execution of the purchase contract

1.    The conclusion of the Sales Agreement between the Customer and the Seller takes place upon a prior placing order by the Customer via the Order form in the Online Store in accordance with § 7 of the Terms and Condition.

2.    After placing the order by the Customer, the Seller shall immediately confirm its receipt and at the same time accept the Order for execution. The confirmation of receipt of the Order and its acceptance for implemention shall take place upon the e-mail sent by the Seller to the e-mail address of the Customer provided at the time of placing the order, which contains at least the Seller’s confirmation of receipt of the order, its acceptance for implementation and confirmation of the conclusion of the Sales Agreement. Upon receipt of the above e-mail by the Customer, a Sales Agreement is concluded between the Customer and the Seller.

 3.    If the Customer selects: An electronic payment or a payment by credit card, the Customer is obliged to make the payment within 2 calendar days from the day of the conclusion of the Sale Agreement  – otherwise the Order will be cancelled.

4.     If the ordered Products have different delivery dates, the delivery date is the longest given date.

5.    The beginning of the delivery date to the customer is calculated as follows:

         If the Customer selects the electronic payment method or payment by a credit card – from the day of crediting the bank account of the Seller.

         In case of ordering Products with different dates of readiness for collection, the       deadline for receipt is the longest given date.

6. Delivery of the product takes place within the European Union and beyond.

7. Delivery of the Product is made upon payment, unless the Sales Agreement provides otherwise. The costs of the shippment (charges for transport, delivery and postal services) are indicated to the Customer on the Store’s website while placing the order including the moment when the Customer wishes to be bound by the Sales Agreement.

If the Customer selects an electronic payment or a payment card - from the date of crediting the Seller's bank account.

§ 10

The right of withdrawal

1.    The consumer may withdraw from the Sales Agreement within 14 days without giving any reason.

2.  In the case of withdrawal from the contract, the customer is obliged to return the product within 14 days from the date of notification of withdrawal.

3.    The period stated in point 1 starts running with the delivery of the product to the Consumer or any person other than the carrier designated by him/her.

4.    If the Agreement concerns many products that are delivered separately, in batches or in parts, the date specified in point 1 runs from the most recent delivery of the last item or its part.

5.    The consumer may withdraw from the sales agrement by submitting to the Company a declaration on withdrawal from the Agreement. In order to meet the deadline for withdrawal from the Agreement, it is sufficient for the Consumer to send the declaration before the expiry of the period.

6.    The declaration may be sent via the traditional mail, fax, or e-mail by sending the declaration to the Seller’s e-mail address or by submitting the declaration on the website of the Online Store – contact details are specified in § 3. The declaration may also be submitted on the annex to the Act of 30 May 2014 on the Consumer rights, however, it is not mandatory.  

§ 11

Complaint and warranty

  1. The Purchase Agreement covers new products.
  2. If the defects in the newly purchased product occur, the Customer has the right to make a complaint subject to the provisions on warranty in the Civil Code.
  3. The complaint shall be submitted in writing or electronically to the address specified in the Terms and Conditions or via the Complaint form made available by the Seller on one of the subpages of the online store.
  4. It is recommended that the complaint conclude a concise desription of defects, circumstances of its occurence and its date, data of the Customer submitting the complaint and the claims of the Customer related to the defect of the goods.
  5. The goods returned within the complaint procedure shall be sent to the address specified in § 3 of the Terms and Condition.

§ 12

Extrajudical complaints and claims satisfaction

The Consumer has the exemplary possibilities of using extrajudical means of dealing with complaints and claims of satisfaction: a) The consumer is entitled to request an arbitration consumer court, referred to in art. 37 of the Act of 15 December 2000 on the Trade Inspection (Journal of Laws from 2014, item 148, as amended), to settle the dispute arising from the Contract concluded with the Seller. b) The consumer is entitled to apply to the provincial inspector of Trade Inspection, pursuant to art. 36 of the Act of 15 December 2000 on the Trade Inspection (Journal of Laws from 2014, item 148 with later amendments), with a request to initiate mediation proceedings regarding the concilliary settlement of the dispute between the Consumer and the Seller. c) The consumer can get free assistance in settling the dispute between him/her and the 

§ 13

Personal Data  

1.   The Administrator of the personal data of the Customers collected via the Online Store is the Seller.

2.   Peronal data of the Customers collected by the Administrator via the Online Store are collected in order to implement the Sales Agreement and if the customer so Agrees  also for the marketing purposes.

3.   The Recepients of personal data of the Online Store’s Customers may be:

a.    If the Customer selected the method of delivery by post or courier, the adminitrator provides the personal data collected to the selected carrier or intermediary performing the shippment at the request of the administrator

b.    If the Customer is using the electronic payment or payment by a credit card the administrator is provides the collected personal data of the Customer to the selected entity servicing the above payments in the Online Store.

4. The Customer has the right to access the data and their amendment.

5. Providing personal data is voluntary, however failure to provide the personal data specified in the Terms and Conditions may result in the inability to conclude this contract.

§ 14

Final provisions

1. The language of the Contracts conluded via the Online Store shall be Polish.

2. The Seller reserves the right to make any amendments to the Terms and Conditions of the Online Store upon the important reasons such as changes in the law, changes in methods of payment and  methods of delivery, to the extent to which   these changes affect the implementation of the provisions of the Terms and Conditions. The Customer shall be notified by the Seller about any changes made at least 7 days in advance.

3. In matters not covered by the Terms and Conditions, the provisions of Polish Law shall apply, in particular Civil Code, the Act on the provision of electronic services, the Consumer Rights Act, the Act on the Preotection of Personal Data.

4. The Customer has the right to use any extra judicial means of dealing with complaints and redress. To this end the Consumer can make a complaint via the EU ODR platform available under the following address http://ec.europa.eu/consumers/odr/.
